By submitting my reservation request on this website online or verbally with an authorized representative of BID, LLC dba as BOOKGRANDCANYONHELICOPTERS.COM, (“BGCH”) I acknowledge that I have read and agreed to: THE TERMS & CONDITIONS and ACKNOWLEDGEMENT OF RISK, TOUR BOOKING, WEBSITE USAGE AGREEMENT, PARTICIPANTS LIABILITY, and LIMIITATIONS ON LIABILITY AS STATED BELOW: ONLINE TOUR BOOKING CONDITIONS & WEBSITE USAGE AGREEMENT, as stated below.

BID, LLC dba BookGrandCanyonHelicopters.com corporate office is located at 3230 S. Buffalo Dr. Suite 107, Las Vegas, Nevada 89114.

Bally’s Hotel & Casino 3645 S. Las Vegas Blvd., Las Vegas, Nevada 89109. Licensed as Admin & Support Services – Group 1, H-1 zone. Approved tour guide service in conjunction with an existing resort hotel. (ZC-96-0310). License Number: 2006653-056-101.

BGCH sells tours, attractions, travel adventures, and show tickets to the public and commercial clients for suppliers that provide tours, attractions, travel adventures, and show tickets. BGCH in most cases, is not the provider of the tours, attractions, travel adventures, and show tickets.

ONLINE OR IN PERSON TOUR BOOKING TERMS, CONDITIONS & PRIVACY POLICY

ONLINE AND IN PERSON BOOKINGS: Your credit/debit card will be charged the full tour retail amount Including any applicable fees and/or fuel surcharges, at the time you place your booking order. Information and instructions will be supplied after securing your booking. Your departure date and time will be emailed or handed to you within 24 hours. For all bookings made within 24 hrs. of travel date, please call our Reservations Department – Call Center directly at: +1-833-274-7827(10am to 10pm PST) or stop by one of our convenient Attraction Desks located at the LINQ Promenade or Bally’s Hotel & Casino.

VALID IDENTIFICATION REQUIRED: A valid photo identification will be required at the time of check-in. This can either be a valid Government issued passport or Driver’s license. If you purchased your tour with a credit card, please bring the original form of payment as proof of purchase. It is a Felony Crime to board an FAA Approved Part 135 Air Carrier using a stolen or Fraudulent credit card.

CANCELLATION & NO SHOWS: 48 hours cancellation notice of the applicable tour day/day/date is required for Grand Canyon Helicopter and Las Vegas Night Strip Helicopter Tours. Not showing up for your tour or tours canceled within 48 hours of the applicable tour day/date/time will result in 100% cancellation fee of the applicable retail price Deposits are nonrefundable unless tours is cancelled by the helicopter tour operator for poor weather or mechanical issues. Note: 30 days cancellation notice required for Grand Canyon West Overnight Cabin Stay tours. 7 days cancellation notice required for Grand Canyon, Valley of Fire and Las Vegas Night Strip helicopter Wedding Packages. NO SHOWS are subject to 100% of the applicable tour retail price. All cancellations made within the applicable required notification period are subject to a $25.00 processing fee (per person).

GUEST SERVICE: Customer service feedback must be submitted within 30 days of the applicable tour day/date of travel in writing to BookGrandCanyonHelicopters.com 3230 S. Buffalo Dr., Suite 107, Las Vegas, Nevada 89117. Attention: Guest Services.

REFUNDS: In the event service(s) described in the applicable BGCH, tour itinerary cannot be provided due to cause beyond the control of BGCH, we will exercise all efforts to provide comparable service(s). If your tour itinerary package is canceled and comparable service(s) cannot be provided, BGCH, will refund all monies paid to BGCH. Please allow up to five (5) business days for refund processing. Refunds will not be given for any unused portion of a tour.

PRICES: Prices are in U.S. Dollars and are subject to change without notice. All tour prices listed maybe be already discounted unless otherwise noted and they may not be combined with any other offer (e.g., Coupons, Saver Programs, etc.). Fees made be added to your tour price at check-in. BGCH may not have control of fuel surcharges, park entry fees, & landing fees or any other fees imposed in advance or at the time of check-in by the applicable tour operator.

IMPORTANT ADDITIONAL INFORMATION: Any applicable fees that may be denoted in each tour description are also denoted on the check-out page of the shopping cart prior to payment and will also be listed on the final confirmation once booking request is received and approved by BGCH.

If the tour request is initiated by phone or in person with a BGCH agent, BGCH agent will make every effort to notify our guests of any fees that are applicable to their tour. Any guests who request their tour online or by chat line, we strongly recommend that they refer to the tour descriptions as well as the Terms & Conditions for any fees that may be applicable to their selected tour. Fuel surcharges if any are subject to change without notice and may be payable at the time of check-in.

Departure times listed and pricing may vary based on availability. Tour itinerary, tour components, hotel pick-up, and drop-off locations, flight times, descriptions and prices are subject to change at any time for any reason without notice which may also include availability, flight routing differentials, inclement weather conditions, FAA restrictions, and/or any other unforeseen circumstances or occurrences. Suppliers reserve the right to upgrade guests onto another tour. Flight times are approximate and may include loading and unloading.

Children 12 years and under must be accompanied by a Parent or Guardian. Children (2) years of age must purchase a seat at the applicable retail price. Prices and itineraries are subject to change without notice. Tours require a minimum of four (4) passengers to operate.

RECONFIRMATION: Reservations must be reconfirmed 48 hrs. in advance of the applicable tour day/date/time by calling the tour operator indicated on your confirmation voucher. Failure to reconfirm your applicable flight/tour may result in you being offloaded from your originally booked tour day/date/time.

COMFORT & SAFETY: In the interests of comfort and safety, Helicopter & Fixed Wing Aircraft exceeding 250 lbs./ 114 kg. / 18 stone will be required to purchase an additional seat at the applicable retail price, Due to weight restrictions seat assignments cannot be guaranteed. Passengers exceeding stated body weights may be off-loaded at the time of check-in. Requests cannot be guaranteed and are subject to aircraft weight and balance safety compliance.

FLIGHT ROUTES/TIMES: For safety, flight routes and flight times may vary due to weather conditions. BGCH, reserves the right to upgrade passengers onto another tour. Flight times are approximate and include loading and unloading.

RETAIL PRICES, APPLICABLE FEES & FUEL: Retail prices, applicable fees, and fuel surcharges may not be included in the price of the tour unless otherwise stated and are subject to change without notice. Prices listed are in U.S. dollars.

WEBSITE USAGE AGREEMENT: BGCH, maintains BGCH (the site) and all the information, data, software, photographs, logos, graphs, videos, typefaces, graphics, music, sounds, images, illustrations, designs, icons, and other materials (collectively “Content”) for your information on tours and services sold by BGCH. All Content in and on our site is for information purposes only. By using this site, you agree to these terms.

COPYRIGHTS: All Content on the website is copyrighted (unless otherwise noted), and may not be used, except as provided in these terms, or in the text on the site, without the prior written permission of BGCH. Content on the site is either the property or used with the permission by BGCH.

TRADEMARKS: The trademarks, service mark, design, and logos (collectively the Trademarks) displayed on our website are the registered trademarks of BGCH. Nothing contained on the Site should be construed as granting, by implication or otherwise, any license or right to use any Trademarks displayed on the site without the written permission of BGCH.

USE OF SITE: Only approved third-party resellers and vendors may use or download Content for the promotion of BGCH, products or tours. You may not use or download content for any other commercial purpose without BGCH, prior written permission. BGCH also assumes no responsibilities, and shall not be liable for, any damages to, or viruses that may infect your computer equipment or other property on account of your access to, use of, or browsing in the Site or any downloading of Content from the Site. BGCH may at any time modify these Terms of the Site Usage and your continued use of the Site will be conditioned upon the Terms of the Site Usage in force at the time of your use.

PRIVACY POLICY: Your privacy is important to BGCH. Your email address and name, street address, and telephone numbers are stored in our database. BGCH will not sell, rent, trade, or give your name, email address or any other personal information to any other organization. However, BGCH, reserves the right to release information to the appropriate authorities, if we believe that such release is reasonably necessary to comply with the law or to protect the property of BGCH, or safety of BGCH, or any of its affiliated companies, our employees, users, or others. PARTICIPANTS LIABILITIES:

The Participant acknowledges and agrees that the Participant releases BGCH from any liability with respect to any injuries, loss or damages which may be sustained by the Participant while undertaking any adventure or attraction, whether dangerous, hazardous, or otherwise.

The Participant unconditionally agrees to fully indemnify BGCH and all of its servants, agents, clients and employees against any injury, damage or accident that may be sustained by the Participant, while participating in an adventure or attraction booked through BGCH or the Entities and Groups who offer various services to BGCH and also including adventures won as prizes or promotions.

The Participant warrants that he/she does not suffer from any Medical Condition and/or incapacity which may impair the Participants ability to participate in an adventure or attraction and further, that the Participant does not suffer from any Heart Condition, Epilepsy or other Medical Condition which may result in the Participant potentially placing himself/herself in a position of risk, by undertaking an adventure or attraction booked through BGCH BGCH will not be responsible for any loss, injury, or damage incurred or suffered by the participant during an adventure or attraction.

The Participant pledges that no legal action will be initiated by it against BGCH its clients, its agents, employees, instructors, and/or personnel, due to an accident or injury sustained during the course of undertaking an adventure or attraction booked through BGCH

Limitations on Liability; Warranties

BGCH, ITS USE AND THE RESULTS OF SUCH USE ARE PROVIDED ON AN “AS IS” BASIS. BGCH MAKES NO EXPRESS OR IMPLIED WARRANTIES OR REPRESENTATIONS WITH RESPECT TO OUR WEBSITE, OR ANY OF THE PRODUCTS OR SERVICES SOLD THROUGH OUR WEBSITE, AND IN NO EVENT SHALL BGCH ITS ASSOCIATES BE LIABLE TO YOU OR ANY THIRD PARTY FOR ANY DAMAGES OF ANY KIND ARISING FROM OR RELATED TO YOUR USE OF OUR WEBSITE, AFFILIATED COMPANIES’ PRODUCTS AND/OR SERVICES OR YOUR DISPLAY OF ANY MATERIAL, CONTENT OR OFFERS ON OR THROUGH YOUR WEBSITES AND/OR E-MAILS AND/OR ANY OTHER INTELLECTUAL PROPERTY INCLUDING, BUT NOT LIMITED TO, SPECIAL, INDIRECT, INCIDENTAL, PUNITIVE AND/OR CONSEQUENTIAL DAMAGES EXCEPT WHERE PROHIBITED BY VIRTUE OF LAW, EVEN IF GC FLIGHT OR ITS ASSOCIATES HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR WEBSITE, ALONG WITH ANY MATERIALS, OFFERS, PROGRAMS, DATA, ADVERTISERS’ UNDERLYING PRODUCTS AND SERVICES, INFORMATION AND CONTENT ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS AND ALL WARRANTIES, EXPRESS AND IMPLIED, ARE DISCLAIMED (INCLUDING, WITHOUT LIMITATION, THE DISCLAIMER OF ANY WARRANTIES OF MERCHANTABILITY, NON-INFRINGEMENT OF INTELLECTUAL PROPERTY AND/OR FITNESS FOR A PARTICULAR PURPOSE). BECAUSE SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF INCIDENTAL OR CONSEQUENTIAL DAMAGES, THE ABOVE EXCLUSION(S) MAY NOT APPLY TO YOU. IN SUCH JURISDICTIONS, GC FLIGHT AND, AFFILIATES’ LIABILITY IS LIMITED TO THE SMALLEST AMOUNT PERMISSIBLE BY LAW. THIS SECTION WILL SURVIVE THE FAILURE OF ANY EXCLUSIVE OR LIMITED REMEDY.

DISPUTES – CHOICE OF LAW: This Agreement and any breach arising from it shall be deemed to have commenced in Las Vegas, Nevada, USA. You agree that only the laws governing Agreements formed and breached in Las Vegas, Nevada, USA, shall apply to this Agreement.

STATUTE OF LIMITATIONS: Notwithstanding any other provisions at law, you agree that any cause of action arising from or related to this Agreement must be commenced within one year of the date that the cause of action occurs. You agree that any action not commenced within this time shall be permanently barred.

ARBITRATION: If a dispute with us arises from or relates to this Agreement or your use of our service, you agree that, unless otherwise not allowed by law, the dispute will be resolved according to an arbitrator in accordance with the rules of the American Arbitration Association.

IN CASES OTHER THAN ARBITRATION: If a dispute cannot legally be resolved by arbitration, you agree to resolve the dispute in a court that is allowed to decide the case in Las Vegas, Nevada, USA. If there is no court allowed to decide the case in Nevada, then you (or we, as the case may be) can bring the case in the next closest court to Nevada that has the authority to hear and decide the case.

NON_COMPLIANCE WITH THESES PROVISIONS: If you bring a lawsuit that does not comply with the terms found in this “Disputes” section, you agree that we may inform you of your error, and, if you do not withdraw the lawsuit after we inform you that it breaches this Agreement, we can have the lawsuit dismissed from the court that you filed it in. If this occurs, you agree to pay for our reasonable attorneys’ fees incurred to obtain the dismissal, as well as up to $2,000 for our court fees and disbursements.
